Terms of Service

1. Acceptance of These Terms

By accessing the site, creating an account, viewing or downloading a gallery, purchasing a license, or otherwise using our services, you represent that you are at least 18 years old and that you have the authority to enter into these Terms on your own behalf or on behalf of the organization you represent.

Your use of the site is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information.

2. Our Services

SF Event Photo provides event photography and video services, online galleries, image licensing, and related digital delivery tools. Specific deliverables, coverage, pricing, and timelines are established by a separate written agreement, statement of work, or order confirmation (an “Engagement Agreement”) between SF Event Photo and the contracting client.

Nothing on the site constitutes an offer to contract. An Engagement Agreement is formed only when SF Event Photo and the client have both agreed in writing to its terms.

3. Accounts

Account responsibility

Some features require an account. You are responsible for providing accurate information, keeping your credentials confidential, and for all activity that occurs under your account. Notify us promptly at bookings@sfeventphoto.com of any suspected unauthorized use.

Eligibility

You may not create an account or use the services if you are prohibited from receiving them under applicable law, or if we have previously terminated your access.

4. Galleries and Access

Galleries may be public, unlisted, password-protected, restricted to specific email domains, or gated by a download code. Access to a gallery is granted subject to the access method chosen by the client who commissioned the event and may be modified or revoked at any time.

Gallery access is personal to the authorized user and is not transferable. Attempts to share, bypass, or circumvent access controls are prohibited and may result in suspension or termination of your account.

5. Licenses, Purchases, and Downloads

License scope

Each image or video available for purchase is offered under one or more defined license tiers. The tier you select at checkout governs the permitted uses, duration, territory, and any restrictions for that specific image. A purchase grants you a limited, non-exclusive, non-transferable license to use the content within the scope of the tier selected. All rights not expressly granted are reserved by SF Event Photo.

Payment

Prices are shown at checkout in U.S. dollars. Payments are processed by our third-party payment processor. All sales are final unless otherwise required by applicable law or agreed in writing by SF Event Photo. Taxes may apply based on your location.

Downloads and tokens

Download links and tokens are single-purpose, may expire after a set period, and may be revoked in connection with a refund or suspected misuse. You agree not to share download links or tokens with third parties.

Free or complimentary downloads

Where SF Event Photo offers free downloads from a gallery, those downloads are provided for personal or internal-business use only and may not be used for paid advertising, resale, sublicensing, or any use outside the scope described in the Engagement Agreement for that event.

6. Intellectual Property

All images, videos, captions, layouts, graphics, code, and other content on the site are owned by SF Event Photo or its licensors and are protected by U.S. and international intellectual property laws. Except for the limited license you receive when purchasing a specific image or expressly granted rights under an Engagement Agreement, no ownership or intellectual property rights are transferred to you.

7. Permitted Use

Subject to these Terms and any license tier you have purchased, you may view the site, view galleries to which you have been granted access, and use licensed content within the scope of the applicable license.

8. Prohibited Conduct

You agree not to:

• Copy, scrape, mirror, republish, sublicense, or resell any content from the site except as expressly permitted by a license you have purchased or by a written agreement.
• Circumvent gallery access controls, password-protected areas, or download tokens.
• Remove watermarks or any attribution, copyright, or rights-management information.
• Train machine-learning or generative AI models on our images or videos without our prior written consent.
• Use the site or any content in a way that is unlawful, harassing, defamatory, infringing, or harmful to others.
• Probe, scan, or test the vulnerability of any system or network connected to the site without authorization.
• Introduce viruses, worms, or other malicious code, or interfere with the site’s normal operation.
• Attempt to reverse-engineer or extract the source code of any part of the site.

9. Third-Party Services

The site uses third-party services for hosting, payments, email delivery, content management, and other functions. Those services operate under their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

10. Event Subjects and Likeness

Photography and video captured at events may depict attendees and other participants. The right to use these images for a particular purpose depends on the applicable Engagement Agreement with the client who commissioned the event and on any release agreements the client obtained from attendees. If you believe an image of you is being used without appropriate authorization, contact us at privacy@sfeventphoto.com and we will review the request in good faith.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, SF EVENT PHOTO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SF EVENT PHOTO AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO SF EVENT PHOTO FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless SF Event Photo and its officers, employees, contractors, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the site, or your violation of any law or the rights of any third party.

14. Termination

We may suspend or terminate your access to the site or any account at any time for any reason, including violation of these Terms. Upon termination, your right to use the site ends, but the sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue in effect.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the site will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction and venue in those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual-property rights.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the “Last updated” date above. Continued use of the site after an update constitutes acceptance of the revised Terms.
